Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, dashboard, and services (the "Services") of BIZY TECHNOLOGIES LLC, a Wyoming limited liability company trading as MightWork. By using the Services, you agree to these Terms.

Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You are responsible for the activity on your account and for keeping your credentials secure.

Accounts

You must provide accurate information when creating an account and keep it up to date. We may suspend or terminate accounts that violate these Terms.

Intellectual property

The Services and their content are owned by MightWork and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Services.

Marketing accounts and assets

Where we run marketing for you, advertising accounts, tracking pixels, landing pages, creative and automations that we create are held in the MightWork Business Portfolio and remain ours unless your engagement letter says otherwise. You get named access to them for as long as the engagement is active, and your advertising budget is charged to your own payment method, never marked up.

Assets you already owned when the engagement began — your social pages, domain names, Google Business Profile and any account you brought with you — remain yours, and we hold only delegated access to them, which we release when the engagement ends.

Your customer data is yours. Leads, names, contact details and their history are your property. You can request an export at any time, including after the engagement ends, and we will provide it in a common machine-readable format. Transfer of any account we created is available only where your engagement letter provides for it and the relevant platform permits it.

Disclaimers

The Services are provided "as is" without warranties of any kind. We do not guarantee specific marketing results.

Limitation of liability

To the maximum extent permitted by law, MightWork is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.

Changes to these Terms

We may update these Terms. When we do, the "last updated" date at the top of this page changes and the new version applies from the day it is posted. Continued use of the Services after that constitutes acceptance.

A change that materially affects your rights is different. If we change the marketing accounts and assets section, your right to export your data, the limits on liability, or how disputes are handled, we will email account holders at least 30 days before it takes effect, and it will not apply to anything that happened before that date. If you would rather not accept it, close your account before it takes effect and it will not apply to you.

If you have signed an agreement with us, that agreement governs. A signed Master Services Agreement can only be changed by a written amendment that both of us sign. Nothing posted on this page changes it, and where the two disagree, your agreement wins.

Changes to the text-messaging section below work differently again, because what you agreed to is recorded separately from this page — see SMS Terms & Conditions.

Text messages (SMS)

BIZY TECHNOLOGIES LLC, trading as MightWork, sends text messages from (201) 770-6046, (209) 315-3622 or (833) 377-2603. We send two kinds, and they are agreed to differently. Giving us a number for an enquiry or a booking is how you agree to messages about that enquiry or booking. Marketing is a separate yes, with its own box on our forms, and that box is never ticked for you:

• Non-marketing: replies to something you asked us, a notice that your consultation or monthly report is ready, appointment confirmations and reminders, and service notices about work we are doing for you.
• Marketing: offers, new services, and things we think are worth testing.

Consent to receive texts is never a condition of any purchase and is never required to submit a form. These are recurring messages; message frequency varies with what you asked for — typically fewer than 6 messages per month. Message and data rates may apply; we do not charge for messages, your carrier may.

Reply STOP to any message to opt out — you will get one confirmation and nothing after that. Reply START to opt back in, or HELP for help. You can also reach a human at hello@mightwork.us or (201) 770-6046.

Carriers are not liable for delayed or undelivered messages.Delivery depends on your carrier's network and your device.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
